Syllabus

Course Objectives

The course aims to provide students with knowledge of the sources, fundamental concepts, and institutions of private law, with a particular focus on family law and the protection of minors and vulnerable adults, while also taking into account the most recent legislative changes.

By the end of the course, students should achieve the following learning objectives:

- clear knowledge of the sources, institutions, and fundamental concepts of private law;

- ability to interpret and apply legal provisions in the contexts in which educators operate;

- ability to argue and express their thoughts clearly and using legal language, and to identify solutions to legal problems;

- ability to engage with teachers and students on the topics covered.

Lectures, guided classroom discussions, seminars and round tables with industry experts


Assessment Methods

The final exam consists of an oral exam. The evaluation criteria used to assess learning outcomes during the oral exam include:

- the completeness and relevance of the knowledge acquired

- the ability to critically analyze the legislation and case law examined

- proficiency in the use of legal language

Criteri di valutazione:

Ai fini dell'attribuzione del voto si seguiranno i criteri seguenti:

30 e lode: conoscenza completa, approfondita e critica degli argomenti, eccellente proprietà di linguaggio, completa ed originale capacità interpretativa, piena capacità di applicare autonomamente le conoscenze per risolvere i problemi proposti;

28 - 30: conoscenza completa e approfondita degli argomenti, ottima proprietà di linguaggio, completa ed efficace capacità interpretativa, attitudine ad applicare autonomamente le conoscenze per risolvere i problemi proposti;

24 - 27: conoscenza degli argomenti con un buon grado di padronanza, buona proprietà di linguaggio, corretta e sicura capacità interpretativa, buona capacità di applicare in modo corretto la maggior parte delle conoscenze per risolvere i problemi proposti;

20 - 23: conoscenza adeguata degli argomenti ma limitata padronanza degli stessi, soddisfacente proprietà di linguaggio, corretta capacità interpretativa, più che sufficiente capacità di applicare autonomamente le conoscenze per risolvere i problemi proposti;

18 - 19: conoscenza di base degli argomenti principali, conoscenza di base del linguaggio tecnico, sufficiente capacità interpretativa, sufficiente capacità di applicare le conoscenze di base acquisite;

Insufficiente: non possiede una conoscenza accettabile degli argomenti trattati durante il corso.

Attending students will be able to take an intermediate evaluation test concerning the first part of the course (from general notions to inheritance law included)

Once the exemption test has been passed, the final exam will cover the remaining part of the program.

The natural person and collective bodies

The law of obligations and contracts in general. Facts and legal acts. The contract: the essential elements. Contracts between professionals and consumers and the protection of the weaker contractor. The effects of the contract. Withdrawal from the contract. The contract and third parties. Condition and term. Representation. The invalidity of the contract (causes and consequences).
