(In)certezza del diritto e Stato giurisdizionale: il caso dell’abuso del diritto e del processo (riflessioni a margine di V. Omaggio, Saggio sullo Stato costituzionale, Torino, 2015),

After a brief presentation of Vincento Omaggio’s book “Studi sullo Stato costituionale”, the author focuses on a recurring theme: the huge growth of jurisdiction, inside the crisis of the sources system, and the dangers that the legal certainty may run in such a context. In particular, we’ll try to obseve (having a crtical approach) the above mentioned aspects through a specific interpretation: the recent use that our law, also administrative law, does as regard the abuse categories of the law and of the process. Finally, we’ll attempt to link the different parts of the speech by defending the principle of legal certainity inside the Constitutional State.
