abstract:
The book aims to reconstruct and to examine critically, with a methodologically correct approach, the evolution of union representation in the workplace, reviewing the major problem areas and evaluating prospects in key trans-national. The work is divided into two parts, between them dialectically related. The first section ("trade union representation and models of social partnership") faces in key reconstruction, the historical model of promotion, of which Article. 19 of the Statute of the workers was a central element, constituent, and considers dialectically in parallel, taking into account the reciprocal relationship, the impact on the level of union representation, to the definition of "new rules" union. The author then addresses the reform of self-promotional model of union representation, resulting from the Protocol on incomes policy in July 1993 and the subsequent Accordo Interconfederale of 1993 on the unitary union representatives, with the understanding and correlating the issue of representation with trade union representation and models of social partnership. The study is concerned, from these premises, the main problems of the new model of joint representation and conflicts emerged in court, according to the author are the result of the ambiguous compromise between associative principles and new union rules. The work then focused on legislative reform in the system of representation and representativeness of trade unions in the public sector introduced in 1997, assessing the scope and differences with the private sector model. The first section concludes with a chapter devoted to the prospects of legislative reform sindacale representation and its limits, to define, in a critical, major dystonias between new paradigms and old ideologies foreshadowing a possible crisis of the unified fabric.
In the second section the author focuses his research on "new frontiers" of union representation, devoting the first chapter on the theme that emerged strongly in recent years, the reorganization of representation in relation to "new jobs" and the size Local (lands productive as a paradigm of a new center of gravity for the same industrial action), from which the profound modification of such interests to be represented. The last chapter deals with another "border", resulting from the projection of the trans-national representation. The European works councils representing, in this view, a fundamental redefinition of the "boundaries" and the representation of interests to be protected, the author analyzes and comments on both the general plan (considering the scope of Community social dialogue and the role of the European integration process) is tackling the most problematic issues.
A summary index with bibliography concludes the volume, which is presented, with a foreword by Bruno Caruso.
