Course Objectives
The course is aimed at providing students with the fundamentals of private law through the transfer of useful notions for the acquisition of technical-legal language and knowledge of the main institutions of private law.

The exam format is the classic oral exam.
Criteri di valutazione:
Ai fini dell'attribuzione del voto si seguiranno i criteri seguenti:
30 e lode: conoscenza completa, approfondita e critica degli argomenti, eccellente proprietà di linguaggio, completa ed originale capacità interpretativa, piena capacità di applicare autonomamente le conoscenze per risolvere i problemi proposti;
28 - 30: conoscenza completa e approfondita degli argomenti, ottima proprietà di linguaggio, completa ed efficace capacità interpretativa, attitudine ad applicare autonomamente le conoscenze per risolvere i problemi proposti;
24 - 27: conoscenza degli argomenti con un buon grado di padronanza, buona proprietà di linguaggio, corretta e sicura capacità interpretativa, buona capacità di applicare in modo corretto la maggior parte delle conoscenze per risolvere i problemi proposti;
20 - 23: conoscenza adeguata degli argomenti ma limitata padronanza degli stessi, soddisfacente proprietà di linguaggio, corretta capacità interpretativa, più che sufficiente capacità di applicare autonomamente le conoscenze per risolvere i problemi proposti;
18 - 19: conoscenza di base degli argomenti principali, conoscenza di base del linguaggio tecnico, sufficiente capacità interpretativa, sufficiente capacità di applicare le conoscenze di base acquisite;
Insufficiente: non possiede una conoscenza accettabile degli argomenti trattati durante il corso.

1) The legal phenomenon. Law and norms. Private law in the general system. The legal norm. The structure of the legal norm. The Civil Code: historical context. Structure of the Civil Code. The sources of private law. Application and interpretation of legislative texts.
2) Legal situations. Classification of legal situations.
3) The legal entity. The natural person and legal persons. Legal capacity and capacity to act; administration of support; legal incapacity and natural incapacity. Personal rights. Legal entities: activities and organization; types and purposes.
4) The legal object. Things and assets in a legal sense. Patrimony. Categories of assets. Patrimonial universality. Appurtenances. Fruits.
5) Ownership, real rights, and possession. Property: content and limits. Neighborhood relations, emulative acts, immissions. Methods of acquiring property and defense actions. Real rights of enjoyment of other people's property. Surface area, emphyteusis, usufruct, use and habitation, predial easements. Joint ownership. Co-ownership of buildings. Timeshare. Possession and detention. Effects of possession. Actions to protect possession.
6) Obligations and the obligatory relationship. Sources of obligations. Structure and characteristics of the obligation. Duty of fairness, good faith, natural obligations. The subjects of the obligatory relationship. Performance. Events of the obligatory relationship. Objective and subjective changes to the relationship. Implementation and termination of the obligatory relationship. Methods of termination other than performance. Non-performance and default by the debtor. Delay in payment. Default by the creditor.
7) The legal transaction and the contract in general. Private autonomy and contractual autonomy. Formation of the contract. Preliminary contract. Pre-contractual liability. The requirements of the contract - the agreement, the cause, the object, the form. Incidental elements (condition, term, manner). Interpretation of the contract. Representation, contract for a person to be named. Contracts in favor of third parties. Simulation. Invalidity of the contract (nullity and voidability). Rescission. Resolution.
8) Non-contractual sources of obligation. Unilateral promises. Promise to pay and acknowledgement of debt, Promise to the public. Obligations arising from law. Management of business. Payment of unjustified amounts. Unjust enrichment. Tort and non-contractual liability. Compensatory damages. Compensation and quantification. Special forms of civil liability.
9) Debtor's financial liability. General provisions. Real guarantees. Mortgage. Pledge. Means of preserving financial collateral - Precautionary seizure. Subrogation, revocatory action, and precautionary seizure.
