The contribution relates to the relationship between property rights and the protection of cultural heritage, with respect to the limits imposed upon the capability of the private individual, being the owner of artistic heritage, to exploit and use such a property, in order to satisfy the public interest.
After examining the concept of cultural heritage, the author deals with the procedure for imposing constraints by analyzing several types of cultural interest underlying the act of taxation and owner's limits and obligations, depending on the constraint imposed on the property.
