«Usus Auctoritas». Le XII Tavole e la tutela dell’«apparenza» della proprietà

The work proposes a new interpretation of the decemviral phrase "usus auctoritas fundi biennium est, ceterarum rerum omnium quarum annuus estusus", which the doctrine constantly identifies in the correlation between the institution of the usucapion, on the one hand, and the guarantee for eviction in the mancipatio on the other. Through the clarification of the meanings of usus and auctoritas with reference to the historical context in which they appear, the study comes to attribute to the usus a stronger role, relative to the acquisition of property itself: with the usus the XII Tablets tackle the problem of the forms of belonging, regulating the ways of acquisition
