abstract:
After analyzing the concept of ownership in Roman law, the paper discusses the different ways of transfer of ownership, in particular the mancipatio and the traditio, in their historical evolution, from classical law to postclassical and Justinian’s one. The comparison between the responsa of prudentes and the documents of the practice, which represent the vital aspect of this legal phenomenon, allows to propose a revision of some traditional doctrinal opinions
