The contribution approaches, according to a multidisciplinary perspective, the concept of landscape to that of culture. After an overview of historical nature in which the A. briefly describes the origins, European and global security landscape, differentiating it from the conservation of protected areas, briefly analyzes the evolution of the Italian system from the early twentieth century to the Constitution of the Republic of '47. In the following, based on the considerations set out by Salvatore SETTIS in the well-known essay entitled "Landscape, Constitution cement ", criticizes the implementation procedures and the work carried out by the Italian post-war legislator who did not seem in keeping with the dignity given to the landscape by the Fathers constituents. The investigation at this point turn to the allocation of responsibilities in the light of the reform of Title V of focusing on the compatibility between Article. 9 and the new art. 117 of the Constitution in this direction assumes significant importance is the observation of the case law, and in particular the judgments of the Constitutional Court and the Administrative Court. The essay concludes with an analysis of the different types of protection to ensure that the legal landscape as cultural objects can be protected in a transversal manner so that its protection may be invoked in both the public and the individual. This demonstrates the fact that the landscape today is a far cry from the old conception that saw it as the beauty of the whole which was alien to the work of man but in the wake of the teaching coming from beyond the Alps, it is now cultivated landscape for which he became worthy of protection unit in the light of the principle of sustainable development.
