The persistent centrality of the administrative state plays a crucial role in questioning the concept the rhetoric of human rights, and it is extremely perva sive in the field of immigration law, especially regarding the notion of asylum and refugee protection. This according to three different perspectives: the relevance of soft law in the form of administrative circular, the issue of administrative management of the reception, persistent critical issues in the judicial protection of the asylum seeker. It is believed that only by acquiring a greater awareness of this structure it will be possible to better grasp the mechanism of biopower that operates on the asylum seeker who crosses the border, and enters in a gradual journey, marked by the passage from one reception facility to another and from one bureaucratic practice to a different one.
