Syllabus

Course Objectives

As a learning outcome, students are expected to:


a) be familiar with the principal doctrinal areas of penitentiary law;


b) be able to locate in the relevant sources the premises for proposing solutions to interpretive questions;


c) have developed the critical capacity to recognize the close relationship between the cultural context and the applicable legal framework.


Course Prerequisites

To sit the examination in Penitentiary Law, students must have previously passed the examination in Criminal Law.


Teaching Methods

The course is delivered in the second semester through in-person lectures.

The topics covered in the lectures are indicated in the Schedule published in the course syllabus, under the “Teaching Materials” section.

Attendance is optional; however, it is strongly recommended for the purpose of understanding the historical, theoretical, and cultural background to the execution of sentences.


Assessment Methods

The examination consists of an oral interview.

The final grade will be awarded on the basis of the following criteria:


Fail: Inadequate knowledge of the main areas of penitentiary law.

18–21: Sufficient knowledge of the main areas of penitentiary law.

22–24: Good knowledge of the main areas of penitentiary law.

25–27: Good knowledge of the main areas of penitentiary law and the ability to identify their underlying principles and internal connections.

28–30: Good knowledge of the main areas of penitentiary law, the ability to identify their underlying principles and internal connections, and an aptitude for critical reflection.

30 cum laude: Excellent knowledge of penitentiary law, ease in identifying its underlying principles and internal connections, and a marked critical aptitude.

2) An up-to-date Criminal Code and Code of Criminal Procedure which, among the ancillary statutes, includes Law No. 354 of 1975 (“Penitentiary Act”) and Presidential Decree No. 230 of 2000 (“Penitentiary Regulations”).



Contents

The course in Penitentiary Law aims to provide a general framework of the execution of sentences, grounded first and foremost in its historical and theoretical dimensions and attentive to the contributions of the various disciplines that, from different perspectives, examine the experience of detention.


Particular attention is devoted to the following topics:

  1. Purposes of punishment
  2. History of punishment
  3. The penitentiary administration
  4. Prison life and the sociology of imprisonment
  5. The penitentiary regime and the protection of security
  6. Prisoners’ rights
  7. Rehabilitative treatment and its components
  8. Social reintegration, prison benefits, and alternatives to detention
  9. Organized crime (mafia) and prison
