Syllabus

Course Objectives

Through a casistic approach, the course aims to engage students in activities aimed at honing their analytical and reasoning skills on issues related to the developments of contemporary constitutionalism: constitutional interpretation, techniques for the identification and derivation of fundamental rights and the transformation of the rights and status of foreigners.


Course Prerequisites

You must have a thorough knowledge of the Constitutional Law I program and pass the relevant exam.


Teaching Methods

The lessons will be held in presence, through the help of the projector and the material published on the website of the chair and on the website of the Department. In addition to the usual receptions, open to all, attending students can also attend special laboratories to support an intermediate test of exemption of part of the matter.


Assessment Methods

The learning of the course contents will be verified during the lessons, receptions and workshops.


Texts

Attending students will have to take the exam program of the lessons


Non-attending students will have to study for the exam the following text: M. Olivetti, Diritti fondamentali, Giappichelli Torino 2022, first and third part.


Contents

Sec. I - Modern and contemporary constitutionalism. "New constitutionalism" and "political constitutionalism". Interpretation in accordance with the Constitution. Interpretation of the Constitution (originalism, evolutionary interpretation, role of social consciousness). Open questions on the identification and derivation of fundamental rights. Principles, rules and values. Reasonableness and balancing of rights. Constitutionalisation of international law. Interpretation in accordance with the Charters of supra- and inter-national rights (CFREU, ECHR and ESC). The "dialogue" between the Constitutional Court and the legislator in guaranteeing "rights without law" (study of some decision-making techniques). - Sec. II - Constitutionalism and the multiplication of the status of foreigners. The judgment of equality between citizens and foreigners and between foreigners. The social and political rights of foreigners. Law and interculturalism. Citizenship models and reform perspectives.
