Law and Emotions. Annotazioni sullo spazio 'sensibile' del diritto / Siclari, Elena. - In: SUDEUROPA. - ISSN 2532-0297. - 1(2025), pp. 43-58.
abstract:
Law becomes an object of sensitive research, or rather of experience operating in a ‘sensitive’ space consisting of bodies that touch each other in order to discover and understand each other. One thus finds, in the body and corporeality an essential element in addressing the question of the space of law since law requires a certain capacity for thought that feels in the body and emotions its vitality. Sensibility, understood in these terms indicates the ‘energy of living’ the very expression of corporeality that involves all aspects of feeling; a feeling that pertains to sensations, emotions, perceptions, the ability to listen and relate to the other. In this direction, one aims to compare the sensible world with the virtual world that serves as a necessary tool but not a substitute for the human being endowed precisely with 'sensibility.' The jurist thus sees before him an ethical but also a legal ‘challenge’ that aims to think and rethink law in its ‘sensitive’ essence.
