Potere di ordinanza, normalizzazione dell'emergenza e trasformazioni dell'ordinamento

The essay dwells on addresses the issue of “normalising emergency”, focusing mainly on the evolution of the power of ordinance. After a historical analysis of this power, starting from the liberal period up to the 70s-80s of the terrorist emergency, we analyse the most recent evolution of such phenomenon, consider ing the theme of urban security and pandemic emergency. Hence, we come to the conclusion that definitive emancipation of the category of emergency from that of urgent necessity is needed, in the context of a renewed centrality of the notion of the Administrative State.
